CJEU clarifies conditions for transmission and use of evidence in criminal cases with cross-border dimension

The Court of Justice of the European Union (CJEU) on Tuesday 30 April clarified (Case C-670/22), the conditions for the transmission and use of evidence in cross-border criminal cases, in particular those linked to EncroChat, an encrypted telecommunications service used for illegal drug trafficking.

The French police managed to infiltrate this service with the help of Dutch experts and the authorisation of a French court. The intercepted data, which concerned EncroChat users in Germany,...
